This agreement is between PixelDust Solutions LLC, a California limited liability company ("LoveDust", "we", "us"), which offers this service under its LoveDust Films brand, and the person who books and pays for AI Art ("you"). It applies to AI Art bookings only. Our Terms of Use and Privacy Policy also apply. Where they and this agreement disagree about your booking, this agreement wins.
You accept this agreement by ticking the box at checkout. That tick is your signature, and it is binding under the federal E-SIGN Act and California's Uniform Electronic Transactions Act. We keep a record of the version you accepted, when you accepted it, and the email address you used.
1What you are booking
A LoveDust shooter joins your wedding for up to four hours, working alongside your own photographer, and photographs you and your guests. You pick the styles you love from our menu, or mix them, and we turn those photographs into finished, styled images using artificial intelligence.
If you want us for longer, extra hours are $200 each. Arrange it with us before the day if you can, and if you decide on the day, just ask — we will stay if the shooter's schedule allows.
We share photos on the spot during the event, and deliver unlimited edited photos within 24 hours of the end of the coverage window.
"Unlimited" means we place no cap on how many of the frames we captured during your coverage window we finish and deliver to you. It does not mean unlimited shooting time, or images from any source other than that window.
On-site prints are a separate add-on and are included only if you purchased them.
2What is not included
AI Art is something extra on your day rather than a replacement for anything, so here is what it is not — better to know now than to wonder later.
- We are not your photographer. AI Art works alongside the photographer you hired. We do not cover the day the way they do, and what they capture or miss is between you and them.
- We cannot promise a shot list. We photograph what the day gives us, and we go looking for the good moments — but we cannot guarantee that a particular person, group or detail ends up in front of the camera.
- No video, album or prints unless you bought them separately.
- No raw or unedited files beyond what we deliver, unless we agree otherwise in writing.
3Scheduling, and where we travel
The coverage window is up to four continuous hours on your event date, at times we agree with you before the day. If you would like us to start later or stay longer and we can, extra time is $200 per hour, payable before we deliver.
We arrive when we said we would. Weddings run late — we know that, and we plan for it — but the coverage window still ends when your hours are up, because our shooter's day is built around it. If you would rather we stayed, just ask on the day and we will if we can, at the rate above. A late start caused by you, your venue or another vendor does not extend the window on its own, and that time is not refundable.
Where. We photograph at the venue and location you give us when you book. We work across California. If your event is outside the area we normally cover, we will tell you before we confirm your booking, and any travel fee is quoted and paid before the date.
If the location turns out to be materially different from the one you gave us — significantly further away, or with access we could not reasonably have anticipated — we may charge the difference. If we genuinely cannot reach or work the location, section 5 applies as though you had cancelled. A change of venue after booking needs our written agreement and is not always possible, so tell us early if anything about the location changes.
4Price and payment
The price is the amount shown at checkout when you book, in US dollars, and is payable in full at that time. Your booking is confirmed when payment clears; we will also send you a written confirmation. A tick, a form, or a conversation without cleared payment is not a booking, and does not hold your date.
Prices shown elsewhere on our website or in our advertising are not offers, and may change at any time before you check out.
5Cancellation, and moving your date
Plans change, and we would rather move your date than lose you. Start here: you can move your date once, free. Tell us in writing at least 30 days before your event and you can shift your booking to any other date within 12 months of the original, as long as we have a shooter free. We cannot promise availability, so the sooner you ask the better your chances. A second move, or one asked for inside 30 days, is up to us and may carry a fee.
If you would rather cancel outright: cancel more than 90 days before your event and we refund half of what you paid. Inside 90 days, the payment stays with us. That is what holds your date — from the moment you book, we stop offering it to anyone else, and a wedding date is rarely one we can resell when it is close. The figure is our honest estimate of what a late cancellation costs us, agreed up front precisely because that loss is so hard to work out afterwards. It is not a penalty, and it is not us being difficult.
If your booking is not used and not transferred within 12 months of the original date, it expires and no refund or credit is due.
6If we cannot be there
If we cancel your booking, or cannot staff your date, we will tell you as soon as we know, and you choose either a full refund of everything you paid, or a transferred date. That is the whole of what we owe you in that situation, and we are not responsible for any other cost you incur.
If our assigned shooter cannot work your date through illness, injury, or emergency, we may send a qualified replacement instead. You do not get to choose or approve the individual shooter, and a change of shooter is not grounds for cancellation or refund.
7Things outside anyone's control
Neither of us is responsible for failing to perform because of something we could not reasonably control: severe weather, fire, flood, earthquake, power or network failure, illness or epidemic, government order, act of war or terrorism, strike, road closure, or a venue becoming unavailable.
If that happens to us, we will offer you a transferred date within 12 months, subject to availability. If no such date can be found, we will refund what you paid, less any costs we have already incurred for your date that we cannot recover. If it happens to you, section 5 applies: your date can be moved, but the payment does not come back.
8How AI is used, and what that means for your images
This is the most important section in this agreement. Please read it.
Your finished images are produced with artificial intelligence, and they are stylized interpretations — not documentary photographs. By booking, you understand and accept all of the following:
- Likeness will vary. Faces, bodies, proportions, skin, hair, and expressions may be rendered differently from how they appear in the source photograph. We aim for a strong likeness and we tune our process for it, but exact likeness cannot be guaranteed by this technology.
- Details are unreliable in ways that are inherent to AI, not defects in our work. Hands, fingers, jewelry, tattoos, patterns, logos, signage, and any text in an image are commonly rendered inaccurately. Backgrounds and objects may be altered, added, or removed.
- Results vary with conditions. Light, movement, distance, crowding, wardrobe, and how much of a subject is visible all change what the process can do with a frame. Some frames will work beautifully and some will not.
- A style is a direction, not a specification. Choosing a style guides the output; it does not determine it. We do not guarantee that any delivered image will match a sample image, a reference you send us, or a picture in your head.
- Final aesthetic judgment is ours. Which frames we finish, and how far we push a style, is our creative decision, made in good faith and consistent with the work you saw when you booked.
- Our tools change. We are not committed to any particular AI model, vendor, or technique, and we may change them at any time to improve the work.
We do not re-edit delivered images. If a finished image is more stylized than you expected, or a likeness is looser than you hoped, that is the medium rather than a fault we can correct — so it is not grounds for a re-edit or a refund. What we deliver is the work, and it is the work you saw when you booked.
None of that is a licence for us to get it wrong. If something has genuinely failed on our side — corrupted files, images from the wrong event, or a delivery that plainly is not the service in section 1 — tell us within 7 days and we will re-deliver, or refund the part we could not deliver.
9Your photographs and third-party AI services
To produce your images we transmit photographs from your event to third-party AI services operated by other companies, and those services process the images on their own systems. You consent to that. We choose our providers with care, but we do not control them, and we are not responsible for their outages, errors, changes to their services, or security incidents affecting them.
We do not sell your photographs, and we do not submit them to be used as training data for AI systems. We use them to deliver your order, and — subject to section 13 — in our own marketing.
10Your guests, your venue, your permission
By booking, you confirm and promise us that:
- You have the authority to allow photography at your event and at your venue, and you have cleared it with your venue and any other vendor whose permission is needed.
- You will let your guests know that a LoveDust shooter will be photographing the event and that their images will be processed with AI.
- Anyone who appears in a photograph we take has consented to being photographed and to their image being processed and delivered as described here. Where a child appears, their parent or guardian has consented.
We also ask each person directly whether we may use their images in our marketing. Before we photograph someone, our device shows them a box for exactly that; it is described in section 13. Being photographed and having the image processed rest on your promises above and on the guest's participation.
If your venue refuses us access, restricts where or how we may shoot, or ejects us, we will do what we can within those limits, and no refund is due for coverage we were prevented from delivering.
You will cover us for any claim, loss, or cost that comes from a guest, a venue, or another vendor relating to photography at your event or to the use of an image, except to the extent it results from our own gross negligence or willful misconduct.
11Delivery and how long your gallery stays up
Delivery. Photos are sent on the spot during your event. Your full gallery follows within 24 hours of the end of the coverage window — the clock starts when the coverage window ends, not when your wedding ends. We deliver by a digital gallery or download link sent to the email address you gave us at checkout. It is your job to give us an address you can actually receive mail at.
Your gallery stays live for 12 months from the day we deliver it.
Download your images and back them up. After 12 months we are under no obligation to keep them, and we may delete them. If we still hold them and you ask, we may re-deliver them for a fee, but we do not promise they will still exist.
We do not re-edit or re-issue delivered images. See section 8.
12Who owns what
We own the copyright in every photograph we take and every image we produce. You get a perpetual, worldwide, royalty-free licence to use your delivered images for personal purposes: printing them, framing them, sending them to family, and posting them on your own social accounts. A credit to LoveDust Films is appreciated and not required.
You may not sell your images, licence them to anyone else, use them to advertise a business, or enter them into a competition as your own work, without our written permission.
13How we may use your images
We ask each person at the moment we photograph them. Before we shoot, our device shows a box asking whether we may use images of them in our marketing. Ticking it permits that use, and only that. Anyone who does not tick it is photographed and delivered to you as normal; their images are simply not used in our marketing.
Where that consent is given, it grants LoveDust a perpetual, worldwide, royalty-free licence to use those images in our marketing — our website, portfolio, social accounts, paid advertising, and submissions to publications or awards.
You can override it for the whole event. Email hello@lovedustfilms.com before your event date saying you do not want any images from your wedding used in our marketing, and we will honour that across the entire event, whatever individual guests ticked.
If consent is withdrawn after we have already used an image, we will stop using it going forward but cannot recall material already published, distributed, or printed.
We will never use an image of you in a way that suggests you endorse a product or service other than LoveDust Films.
14What we are responsible for, and what we are not
We take this work seriously and we turn up like professionals. Every so often something still goes wrong, and it is only fair that you know where we stand if it does.
Our total liability to you, for anything arising out of this agreement or your booking, is capped at the total amount you actually paid us.
We are not liable for indirect, incidental, consequential, special, or punitive damages, for lost profits, or for emotional distress, even if we were told such damages were possible.
If equipment fails, files are lost or corrupted, or a technical fault means we deliver fewer images than we captured, or none at all, our responsibility is limited to a refund that fairly reflects what we captured but could not deliver, up to the cap above.
Nothing in this agreement limits liability that cannot be limited under California law, including liability for fraud, gross negligence, or willful misconduct.
15Behaviour and safety
Weddings are happy places and this almost never comes up, but our shooter is a person at work. They will step back from anything genuinely unsafe, and they should not have to absorb abuse, harassment, discrimination or drunken aggression from anyone at your event. If it comes to that, we may end coverage and leave; the booking then counts as delivered and no refund is due. We would always try to speak to you first.
One small thing that makes the day easier: it helps enormously if your venue knows in advance that we may need somewhere safe to set up and access to power.
16Payment disputes
If something goes wrong, talk to us first. Email hello@lovedustfilms.com and give us 10 business days to make it right. We would far rather fix a problem than fight about one.
Filing a chargeback or payment dispute for a service we delivered in line with this agreement is a breach of it. If we successfully defend such a dispute, you are responsible for the fees and reasonable costs we incur doing so.
17If we disagree
This agreement is governed by the laws of the State of California, without regard to its conflict-of-law rules.
Before either of us starts a formal proceeding, we agree to try to resolve the dispute directly, in good faith, for 30 days after one of us gives the other written notice of it.
If that fails, any claim must be brought in the state or federal courts located in California, and we each consent to those courts. Either of us may bring a qualifying claim in small claims court instead.
18Changes, and the version you agreed to
We may update this agreement for future bookings. The version you ticked at checkout is the version that governs your booking, and no later change affects it. We keep every version, and we will send you a copy of yours on request.
19The rest
- Entire agreement. This agreement, plus the confirmation we send you and the checkout page you paid on, is the whole of what we have agreed about your booking. It replaces any earlier conversation, email, quote, or advertisement.
- Changes in writing. Any change to this agreement must be agreed by both of us in writing. Email counts.
- Severability. If a court finds any part of this agreement unenforceable, that part is trimmed to the least extent necessary and the rest stays in force.
- No waiver. If we do not enforce something, that does not mean we have given up the right to enforce it later.
- Assignment. You may not transfer this agreement to anyone else without our written consent. We may assign it to a successor to our business.
- Notices. Written notice to us goes to hello@lovedustfilms.com. Written notice to you goes to the email address you used at checkout.
20How you accept this
Ticking the box at checkout means you have read this agreement, you understand it — especially section 5 on cancellation and section 8 on how AI affects your images — and you are happy with it.
